Choco offers a referral bonus to employees of its existing food and beverage distributor customers in the United Kingdom and the United States who refer a new distributor that signs with Choco, subject to these terms and conditions (“Referral Incentive Terms”).
“Choco” means Choco Communications UK Ltd for individuals resident in the United Kingdom or Ireland, and Atlantic Food Waste Partners, LLC dba Choco for individuals resident in the United States. “You” and “Your” mean the individual submitting the referral form in their personal capacity. The applicable country is determined by Your country of residence.
1. Eligibility conditions
1.1. To qualify for a referral bonus, You must meet the following conditions:
1.1.1. refer a new food and beverage distributor to Choco by completing the designated referral form with all mandatory information. At the time Choco receives the referral, the referred distributor must not be an existing Choco customer or already be in an active sales process with Choco; and
1.1.2. before submitting any contact details, obtain the contact’s written agreement to sharing their business contact details with Choco and to being contacted by Choco about its services through the agreed channel.
2. Choco will validate eligibility, record attribution and notify You of the outcome within 30 days of receiving Your referral. Only one referral bonus is payable per referred distributor. If the same distributor is referred more than once, the earliest complete eligible referral received by Choco takes priority. For the purposes of this referral programme, companies under common ownership or control are treated as a single distributor, regardless of their country of establishment. Only one referral bonus is payable per group. Choco will apply these rules reasonably and will not reject an otherwise eligible referral solely because its internal validation was delayed.
3. If the eligible referred distributor signs a binding agreement for a paid Choco subscription within 12 months after Choco receives Your complete referral, You will receive a one-time gift card with a face value of USD 1,000 if You are resident in the United States, EUR 1,000 if You are resident in Ireland, or GBP 1,000 if You are resident in the United Kingdom (“Gift Card”). No bonus is payable for submitting a lead alone and Choco is not obliged to enter into an agreement with a referred distributor.
4. The Gift Card will be provided through the local website Amazon (“Platform”). The Gift Card is subject to the applicable Platform’s redemption terms and conditions, for UK please refer to these terms, for Ireland please refer to these terms, for US please refer to these terms. All such terms and conditions are between You and Platform; Choco is not a party to, and has no liability under, such terms and conditions. The Gift Card is provided on an as-is basis. Choco shall not be responsible for any defects or issues arising from the Gift Card and disclaims liability for any injury or damage suffered by You as a result of use or redemption of the Gift Card. If You are unable or unwilling to accept or otherwise redeem a Gift Card until its expiry, the Gift Card shall be forfeited and no cash or substitutes will be provided in whole or in part.
5. Choco will notify You once an eligible agreement is signed as per section 3 above. To receive the Gift Card, You must provide a valid email address for electronic delivery and any reasonably required tax documentation, including a completed Form W-9 if You are resident in the US. Choco will send the Gift Card to that email address within 30 days after notifying You that You qualify for the Referral Bonus and receiving complete and valid required information and documentation.
6. You must provide accurate information and comply with these Referral Incentive Terms and applicable laws, including anti-bribery laws. Self-referrals, referrals of businesses under common ownership or control with You, and fraudulent referrals are excluded. Choco may reject an affected referral or withhold an affected bonus for fraud or a material breach affecting eligibility, explaining its reasons.
7. You represent and warrant that You have no personal, financial or professional connection with the referred distributor that creates a conflict of interest or could improperly influence its decision to enter into an agreement with Choco. You further represent and warrant that making the referral and receiving the Referral Bonus do not breach Your employer’s policies, any duties You owe to Your employer or any third party, or any confidentiality obligations binding on You.
8. You must collect and share referral information lawfully. You represent and warrant that You have informed the respective data subjects that their personal data will be processed by Choco for the purposes set forth in these Referral Incentive Terms and that the respective data subjects have fully approved and consented to such processing by Choco. Submit only the business contact information needed for the referral. Choco will only use such information for entering into potential business relationships.
9. Choco may change, suspend or discontinue the referral programme for future referrals by publishing a notice on the referral page. Changes will not affect referrals already submitted.
10. This referral programme creates no employment, partnership or exclusive relationship and requires no ongoing sales activity. You should not make any representations on Choco’s behalf.
11. These Referral Incentive Terms are governed by the laws of England and Wales for those resident in the United Kingdom or Ireland, and the laws of the State of New York for those resident in the United States.
12. By checking the acceptance box and submitting the referral form, You confirm that You have read and accept these Referral Incentive Terms in Your personal capacity.
